These Terms of Use and Sale ("Terms") apply to thebaconbin.com and purchases made through The Bacon Bin. By using the site, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the affected services. Nothing in these Terms limits rights that cannot legally be waived.

1. Store and eligibility

The Bacon Bin is an online collectibles store operated from Georgia, United States. You must be at least 18 years old, or use the site with the involvement and permission of a parent or legal guardian who accepts responsibility for the transaction.

2. Collectibles, condition and photographs

Many items are vintage, pre-owned, one-of-a-kind or limited-quantity collectibles. We make reasonable efforts to describe condition accurately. When a listing states ACTUAL ITEM PHOTOS, the photos are intended to depict the specific item offered. Colors and minor visual details can vary by display. Age-related wear, packaging variation and other disclosed condition characteristics are part of the item.

Factory-sealed vintage items are sold based on the observable external condition described and photographed. Unless expressly stated, we cannot guarantee the internal condition of an item that has remained sealed for years or decades. Vintage and collector items may not comply with current toy or child-safety standards and are sold as collectibles unless a listing expressly states otherwise.

3. Prices, errors and inventory

Prices are shown in U.S. dollars unless stated otherwise. The live WooCommerce record controls the price and stock presented during checkout. Adding an item to a cart does not reserve it. We may correct obvious typographical, pricing or inventory errors before an order is accepted. If payment was captured for an order we cannot fulfill, we will cancel/refund the affected amount as required by law.

4. Orders and payment

An order is an offer to purchase. Acceptance occurs when we confirm/fulfill the order, subject to payment authorization, fraud screening and inventory verification. Payment processing is performed by the payment methods/providers enabled at checkout. You agree to provide accurate billing, shipping and account information and represent that you are authorized to use the selected payment method.

5. Taxes

Applicable sales or similar taxes may be calculated and collected at checkout based on the order and destination. You remain responsible for taxes, duties or charges that are legally your responsibility and are not collected by us.

6. Shipping, delays and risk

Our Shipping Policy is incorporated into these Terms. Shipping and delivery estimates are not guarantees unless expressly stated. If an order cannot ship within a promised timeframe, we will provide required delay/cancellation options. Responsibility for loss or damage is determined by the circumstances, carrier process and applicable law.

7. Returns, refunds and cancellations

Our Returns & Refunds Policy is incorporated into these Terms. Opening or altering a collectible can materially change its value and may affect discretionary return eligibility. Nothing in our policy waives non-waivable legal rights for damaged, incorrect or materially misdescribed merchandise.

8. Accounts and account security

You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Use a unique password and notify us if you believe your account has been compromised. We may suspend or restrict accounts when reasonably necessary to address fraud, abuse, security risks, chargeback misuse or violations of these Terms.

9. Collector Journal and user content

You retain ownership of notes and photos you upload. You represent that you have the rights needed to upload them and that they do not violate another person's intellectual-property, privacy or publicity rights. Private entries remain private by default. If you mark an entry public, you grant The Bacon Bin a non-exclusive, worldwide, royalty-free license to host, reproduce and display that public content on The Bacon Bin in connection with the Collector Journal/Showcase. This display license ends when the public content is removed, subject to reasonable technical caching, backup and legal-retention needs.

10. Promotions, coupons and arcade rewards

Coupons, waitlist incentives and arcade-generated rewards may have expiration dates, product restrictions, one-use limits or other conditions. They have no cash value, cannot guarantee inventory, and may be cancelled or refused where generated through abuse, automation, tampering, technical error or violation of the promotion terms.

11. Intellectual property

The Bacon Bin name, Bat Pig branding, original site artwork, interface designs, text and other original store content are protected by applicable intellectual-property laws. Product names, characters and third-party marks remain the property of their respective owners. Reference to a third-party franchise or brand does not imply sponsorship or endorsement.

12. Prohibited use

You may not attempt to disrupt, overload, probe or impair the site; bypass authentication, rate limits, purchase limits or other security controls; conduct credential stuffing, card testing, payment testing, vulnerability scanning or other unauthorized security testing; harvest email addresses or account data; submit malicious code; access another user's account; exploit promotional systems; or use the service for unlawful activity.

Automated indexing by ordinary public search engines is permitted subject to our published crawler instructions. Other scraping, crawling, bulk extraction, automated purchasing or bot activity that copies substantial store content, burdens the service, circumvents controls, interferes with inventory availability, or is used to build a competing catalog or dataset is not permitted without written authorization.

13. Third-party services

The site may interact with WooCommerce, payment providers, carriers, marketplace image hosts and other third-party services. We are not responsible for a third party's independent services, outages, content or privacy practices, except to the extent applicable law provides otherwise.

14. Disclaimer of warranties

To the fullest extent permitted by law, the site and its non-product digital features are provided on an "as is" and "as available" basis. We do not warrant that every digital feature will always be uninterrupted or error-free. Product warranties, if any, are only those expressly stated in the listing or provided by a manufacturer and legally transferable to the buyer.

15. Limitation of liability

To the fullest extent permitted by law, The Bacon Bin will not be liable for indirect, incidental, special, consequential or punitive damages arising solely from use of the site. For claims arising from a purchase, our aggregate liability will not exceed the amount paid for the item giving rise to the claim, except where applicable law does not allow that limitation. These limitations do not exclude liability that cannot legally be excluded.

16. Indemnity

To the extent permitted by law, you agree to be responsible for losses, claims or costs resulting from your unlawful use of the site, your violation of these Terms, or user content you submit that infringes another person's rights.

17. Governing law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except to the extent the consumer-protection law of your home jurisdiction must apply. Any dispute not otherwise resolved will be brought in a court of competent jurisdiction in Georgia unless applicable law requires another forum.

18. Changes, severability and waiver

We may update these Terms prospectively by posting a revised version with a new effective date. If any provision is found unenforceable, the remaining provisions remain in effect to the extent allowed by law. A failure to enforce a provision on one occasion is not a waiver of the right to enforce it later.
